Key Terms Of Selling Agreement
The Sales Agreement / Contract between the Estate Agent and me, the owner and MD of Spectravision, SL and Esfaraia, SL will include the following key terms listed below. The Agreement can be accessed by clicking Sales Agreement.
Sales Agreement
The sales agreement is non-exclusive. The Estate Agents who signed a sales agreement/contract can share the properties also with other agents, but when selling any of the properties, only the Estate Agent who has signed a sales agreement/contract will be entitled to receive the sales commission.
Length & Cancellation of the Sales Agreement
The length of the non-exclusive agreement will be set to a period of 12 consecutive months, and each party can cancel the sales agreement at any time. Once a sales agreement has been cancelled, the Estate Agent is obliged to take the properties off the market.
Sales Commission & Payment
The sales commission is 10% of the sales price if selling any property from the contract within the first 6 months. If sold between 6 and 12 months, the sales commission is 5%. Commission payment is subject to an additional IVA tax @ 21%. The sales commission will be paid to the Estate Agent at the completion of the sale, and at the time of signing the Escritura Publica at the Notary. There will be no prior payments to the Agent.
Rights of the Estate Agent to use listing content
I grant the Agent the rights to use the content of the listings from this website, which includes photos, graphics, videos (if available), descriptions, and any other copyrightable elements related to the properties.
Property Photos
I prefer that the Agent is using the property photos provided in the download section of this website. All photos are correctly sized and optimized for your website. From time to time I will add new photos and/or videos of the properties. To check the availability of newly added media or other updates, please check Announcements.
Property Descriptions
The description of the properties is given as guidance. The Agent has to make his own description, based on the given description on this website, or after the Agent has visited the properties.
Visiting any of the properties
To visit any of the properties – with or without your clients – you have to book a viewing appointment for at least one day prior to the appointment.
Not permitted: to list the exact property address online, placing advertising signs on the property, marketing the properties at different prices then agreed.
